Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and CasaGrown, Inc. governing your access to and use of the MyYardWatch mobile application, web portal (myyardwatch.com), edge computing services, and paired hardware devices (collectively, the "Service").

By downloading, accessing, or using the Service, you represent and warrant that: (a) you are at least 18 years old (or the legal age of majority in your jurisdiction); (b) you have the legal capacity to enter into these Terms; and (c) you either own or have full authorized authority over the real property registered under your account.

A. Tiered Subscriptions & Billing Cycles

MyYardWatch offers free diagnostic scans and paid subscription tiers (e.g., Basic, Pro, Estate) with expanded scan frequencies, AI model capabilities, multi-camera hubs, and telemetry history. Paid subscriptions are billed on a recurring monthly or annual basis as selected during purchase.

B. Automatic Renewal Disclosure

MANDATORY AUTO-RENEWAL NOTICE: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE CONCLUSION OF EACH BILLING PERIOD UNLESS YOU CANCEL AT LEAST TWENTY-FOUR (24) HOURS BEFORE THE END OF THE CURRENT BILLING CYCLE. YOU AUTHORIZE CASAGROWN, INC. (OR OUR THIRD-PARTY PAYMENT PROCESSORS: APPLE, GOOGLE, OR STRIPE) TO CHARGE THE APPLICABLE SUBSCRIPTION FEE AND TAXES TO YOUR DESIGNATED PAYMENT METHOD ON A RECURRING BASIS.

C. Cancellation & Refund Policy

• In-App Subscriptions: Subscriptions purchased via Apple In-App Purchase or Google Play Billing must be cancelled directly in your Apple ID or Google Play account settings.
• Web Subscriptions: Subscriptions purchased via credit card on our website may be cancelled through your MyYardWatch account profile settings.
• No Prorated Refunds: When you cancel, your access continues through the end of the current prepaid billing period. All subscription fees and digital purchases are NON-REFUNDABLE, except where statutory withdrawal rights apply (e.g., European Union 14-day statutory cooling-off period).

MYYARDWATCH AND ITS NIGHT WATCH PERIMETER MONITORING ARE NOT A MONITORED SECURITY SYSTEM, CENTRAL STATION ALARM, OR LIFE SAFETY SERVICE.

• No Emergency Response: The Service does NOT automatically dispatch police, fire departments, private security guards, or 911 medical responders.
• No UL Certification: Our software and paired third-party cameras are not certified by Underwriters Laboratories (UL) or any government fire or security authority.
• No Crime Prevention Warranty: We do not warrant or guarantee that Night Watch will prevent burglaries, break-ins, trespassing, property damage, vandalism, or personal injury. Homeowners are solely responsible for personal security and homeowners insurance.

Diagnostic findings, plant identifications, weed detections, pest analyses, active ingredient suggestions (e.g., copper fungicide, horticultural oil, neem), and curb appeal scores generated by our AI models (Gemini) are provided strictly for educational and informational purposes.

• Chemical Compliance: You are strictly obligated to read and comply with the manufacturer's EPA-approved pesticide/herbicide label, wear recommended Personal Protective Equipment (PPE), and adhere to state/local agricultural regulations. CasaGrown disclaims all liability for chemical burns, phytotoxicity, pollinator harm, or environmental contamination.
• Cost Estimates: Cost-if-untreated figures and repair estimates generated via search grounding are regional automated approximations and do not constitute binding contractor quotes or bids.

You warrant that all cameras connected to MyYardWatch are installed on property you own or lease and are aimed exclusively within your legal property perimeter.

You agree NOT to aim cameras into areas where neighbors or the public maintain an objectively reasonable expectation of privacy (windows, neighboring backyards, bathrooms). You are solely responsible for complying with all federal, state, and local eavesdropping and wiretapping laws (including two-party audio recording consent). You agree to defend and indemnify CasaGrown against any claims alleging unlawful surveillance or privacy invasion.

THE SERVICE IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL CASAGROWN, INC.'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO CASAGROWN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

Platform Intellectual Property: CasaGrown, Inc. retains all right, title, and interest in and to the Service, including the MyYardWatch application, web portal, edge software, AI models, diagnostic scoring algorithms, computer vision pipelines, trademarks, and associated documentation. Nothing in these Terms grants you any ownership rights in the platform or underlying intellectual property.

User Content Ownership: You retain full ownership and all copyright in any original photos, videos, property scans, yard notes, and sensory telemetry that you upload, capture, or transmit through the Service ("User Content").

Processing License: By submitting User Content, you grant CasaGrown a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, analyze, process, reproduce, and display your User Content solely to the extent necessary to deliver, operate, and maintain the Service for your account.

Public Community Content: If you voluntarily choose to publish or share User Content to community exploration feeds (such as social feed reels, growth timelapses, or social reactions), you grant other users of the Service a non-exclusive, view-only license to access, view, and interact with that content within the Service.

Aggregated AI Model Training: You acknowledge and agree that CasaGrown may utilize de-identified, aggregated, and anonymized botanical data derived from scan telemetry to train, benchmark, fine-tune, and improve our computer vision and diagnostic AI models.

Termination by User: You may terminate your account at any time by navigating to your Account Profile settings within the mobile application or web portal and selecting "Delete Account", or by contacting customer support at support@myyardwatch.com.

Suspension or Termination by CasaGrown: We reserve the right to immediately suspend or terminate your access to the Service, with or without prior notice, upon: (a) your breach or violation of any provision of these Terms; (b) fraudulent, abusive, or unlawful use of the Service or payment credentials; (c) continuous account inactivity exceeding twelve (12) consecutive months; or (d) requests by law enforcement or government authorities.

Effect of Termination: Upon termination of your account: (a) all active subscriptions will be cancelled without entitlement to prorated refunds for remaining billing periods; (b) your property scan data, keyframes, and telemetry will be retained for a grace period of ninety (90) days to allow for data export requests before permanent, irreversible deletion; and (c) you may request a downloadable export of your raw scan data prior to the conclusion of the 90-day retention window.

Survival: All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: Section 03 (IoT Actuator & Sprinkler Liabilities), Section 04 (Non-Certified Security Disclaimer), Section 07 (Limitation of Liability), Section 08 (Intellectual Property & Content Ownership), and Section 10 (Mandatory Binding Individual Arbitration & Class Action Waiver).
